Texas Code….”Sec. 552.001.  POLICY;  CONSTRUCTION.  (a)  Under the fundamental philosophy of the American constitutional form of representative government that adheres to the principle that government is the servant and not the master of the people, it is the policy of this state that each person is entitled, unless otherwise expressly provided by law, at all times to complete information about the affairs of government and the official acts of public officials and employees.  The people, in delegating authority, do not give their public servants the right to decide what is good for the people to know and what is not good for them to know.  The people insist on remaining informed so that they may retain control over the instruments they have created.  The provisions of this chapter shall be liberally construed to implement this policy.”

After 2 years of complaining about noxious gas in Gardendale, the EPA finally ‘got wind’ of the Texas Commission on Environmental Quality’s lack of enforcement. Now, the federal agency is looking into why Windsor/Hurt and Berry Petroleum either have not or will not control the fugitive emissions allowed to escape onto resident’s properties.

If these companies insist on developing oil and gas near neighborhoods, then these companies will face regulatory and civil action for their negligent acts…it’s their choice.

Illegal activity in Gardendale

At this moment, Union Drilling (UDI) is moving to another location in Gardenale, TX.  This photo taken moments ago reveals what’s commonly called “double trucking”.  This process allows the rig mast to be moved without disassembling the components.  It saves the company time, it saves the company money, and it is illegal!

The common game played is to have “lookouts” for law enforcement posted along the transfer route to avoid being fined.  Instead of obeying the law, breaking the law is more convenient for oil companies.   A pattern of behavior known all too well by the residents of Gardendale.
